By creating an account or using ATC Test Trainer you agree to these Terms of Service.
If you do not agree, do not use the service. These terms are governed by the laws of
Ontario, Canada.
1. The Service
ATC Test Trainer ("the Service") is an online cognitive aptitude training platform developed and operated by Martianis Corporation, a company incorporated in Ontario, Canada. The Service provides practice modules designed to help users prepare for air traffic controller aptitude assessments.
2. Eligibility
You must be at least 18 years of age to create an account and use the Service. By registering you confirm that you meet this requirement. We reserve the right to terminate accounts found to belong to minors.
3. Account Registration
You are responsible for maintaining the confidentiality of your login credentials.
You must provide accurate, current, and complete information during registration.
One account per person. Creating multiple accounts to circumvent access restrictions is prohibited.
You are responsible for all activity that occurs under your account.
4. Free Plan
Upon registration, accounts receive free access to three (3) modules (M01, M02, M03), each limited to the first three difficulty levels. Free access is provided indefinitely and requires no payment.
5. Pro Plan — Subscription Terms
Pro access is a one-time payment valid for 90 calendar days from the date of purchase.
It is not a recurring subscription and does not auto-renew.
Pro unlocks all 12 training modules with adaptive difficulty and no session question caps.
Access expires automatically 90 days after purchase. Your account, profile, and full session history remain permanently — only the Pro-gated content reverts to Free tier access.
You may purchase again after expiry at the then-current price for another 90-day window. Prior progress carries over.
Pricing is displayed in Canadian Dollars (CAD) and is subject to change. The price at time of purchase is the price you pay.
6. Payment & Refunds
Payments are processed securely by Stripe. We do not handle or store card data.
Refunds are available upon request within 7 days of purchase, provided no more than 20% of the Pro session quota has been used. To request a refund, email support@martianis.com with your order reference.
Refunds are issued to the original payment method and may take 5–10 business days to appear.
Chargebacks initiated without contacting us first may result in permanent account suspension.
7. Acceptable Use
You agree not to:
Reverse-engineer, decompile, or attempt to extract the question bank, algorithms, or scoring logic.
Share, sell, or redistribute generated questions, session data, or answer keys.
Use automated tools (bots, scrapers) to interact with the Service.
Attempt to circumvent access controls, rate limits, or payment verification.
Upload or transmit malicious code, spam, or unlawful content via support channels.
Impersonate another user or Martianis Corporation staff.
8. Intellectual Property
All content, software, question generation algorithms, scoring logic, visual designs, and branding within the Service are the exclusive property of Martianis Corporation or its licensors and are protected by Canadian and international intellectual property law. Nothing in these Terms grants you any ownership right in the Service.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that training with the platform will guarantee success in any official ATC selection process.
10. Limitation of Liability
To the maximum extent permitted by Ontario law, Martianis Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or failure to pass any examination or employment assessment, arising from your use of or inability to use the Service. Our total aggregate liability shall not exceed the amount you paid for the Service in the 90 days preceding the claim.
11. Termination
We may suspend or terminate your account at our discretion if you breach these Terms, with or without notice. You may delete your account at any time by contacting support@martianis.com. Termination does not entitle you to a refund outside the 7-day window.
12. Modifications
We may update these Terms at any time. Continued use of the Service after notice of material changes constitutes acceptance of the updated Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Ontario.
